Privacy Policy

FunctionalMe is an app made by FunctionalMe PBC, Inc., a Massachusetts public benefit corporation (“FunctionalMe,” “we,” “us,” “our”). We also operate under the DBA “FXM Tech Group” for software development activities; this is the same legal entity. You may receive support or technical communications from @fxmtechgroup.com domains, and those come from us.

This Privacy Policy applies to the FunctionalMe mobile app, our website at https://functionalme.app, and any related services we offer (together, the “Service”). It describes how we collect, use, store, and protect your information when you use the App.

To use the App, you must agree to the collection and use of information as described in this Privacy Policy. If you do not agree, you will not be able to use the App.

Account information. When you sign in with Google, we receive your name, email address, and profile photo. We do not receive or store your Google password.

Information you enter into the App. We collect and store the information you choose to enter through your use of the App.

Phone usage data. If you opt in, the App may collect data about how you use your phone, including screen time, per-app usage, notification counts, and pickup frequency. This data is collected only with your explicit permission. You may revoke this permission at any time through the App or your device settings.

Device and technical information. We automatically collect basic information necessary to operate the App, including device type, operating system version, and app version.

Website analytics. Our website uses Google Analytics and Firebase Analytics, which may use cookies and similar technologies to collect information about how visitors interact with the site.

• Infrastructure. We use Google Firebase and Firestore to store and process your data. These services act as data processors on our behalf.
• Payments. Subscription payments are handled by Apple and Google through their respective app stores. We do not receive or store your payment information.
• Legal requirements. We may disclose your information if required by law, regulation, legal process, or enforceable governmental request.

We do not sell, rent, lease, or trade your personal information to anyone for any reason.

You may download a copy of your data or delete your account and all associated data at any time through the App. When you request deletion, your data will be removed from our active systems. Copies may persist in encrypted backups for up to 90 days, or longer if required by an active legal hold.

You may opt in or out of phone usage data collection and push notifications at any time through the App or your device settings.

The App is intended for users who are 18 years of age or older. We do not knowingly collect information from anyone under 18. If we learn that we have collected personal information from a user under 18, we will delete that information promptly. If you believe a user under 18 has provided us with personal information, please contact us at legal@functionalme.app.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Your continued use of the App after any changes constitutes your acceptance of the updated Privacy Policy.

Residents of certain states, including California, Virginia, Colorado, Connecticut, and others, may have additional rights under their state’s privacy laws. Depending on where you live, these rights may include:

• The right to know what personal information we collect about you and how it is used
• The right to request a copy of your personal information
• The right to request deletion of your personal information
• The right to correct inaccurate personal information
• The right to opt out of the sale of your personal information
• We do not sell your personal information. We have never sold personal information and have no plans to do so.

You can already exercise your rights to access and delete your data directly through the App at any time. If you wish to make a request related to any of the rights described above, or if you have questions about your rights under your state’s law, contact us at legal@functionalme.app. We will not discriminate against you for exercising any of these rights.

This Privacy Policy is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions.
