Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of the FunctionalMe mobile application (the “App”) operated by FunctionalMe PBC (“FunctionalMe,” “we,” “us,” or “our”), a public benefit corporation organized under the laws of the Commonwealth of Massachusetts.
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Account Registration

You must sign in using a Google account to use the App. You are responsible for maintaining the security of your Google account credentials and for all activity that occurs under your account. You agree to notify us promptly at legal@functionalme.app if you become aware of any unauthorized access to or use of your account.

3. Subscription and Payment

The App is available through paid subscription plans on a monthly or annual basis. Pricing is displayed in the App and through the applicable app store before purchase.

New users may be eligible for a 30-day free trial. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial expires. Trial eligibility is determined at our sole discretion.

All payments are processed through the Apple App Store or Google Play Store. By subscribing, you agree to the payment terms of the applicable app store. We do not receive or store your payment information.

Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. You may cancel at any time through the Apple App Store or Google Play Store. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods. Refund requests are handled by the applicable app store in accordance with their refund policies.

4. Permitted Use

You agree to use the App only for its intended purpose as a personal tool for understanding your own behavioral patterns and daily functioning. You agree not to:

• Use the App for any unlawful purpose
  Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App’s infrastructure or other users’ access
• Use automated systems, bots, or scripts to access or interact with the App
• Reproduce, distribute, or create derivative works based on the App
• Misrepresent your identity or provide false information
• Use the App to collect information about other individuals

5. Not Medical or Therapeutic Advice

The App is a self-directed wellness and self-awareness tool. It is not a medical device, therapeutic intervention, or clinical service. The insights and information presented by the App are based on data you provide and are intended for personal informational purposes only.

The App does not diagnose, treat, cure, or prevent any medical condition, mental health condition, or disease. Nothing in the App constitutes medical advice, psychological advice, or any other form of professional clinical guidance.

The App is not a substitute for professional medical, psychological, psychiatric, or therapeutic care. If you are experiencing a medical or mental health emergency, contact your local emergency services or a qualified healthcare provider.

Your use of the App does not create a provider-patient relationship, therapeutic relationship, or any clinical relationship between you and FunctionalMe.

6. Your Data

You retain ownership of the data you provide through the App. By using the App, you grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of operating the App and providing its features to you. We do not claim ownership of your data, and we do not use your data for any purpose other than delivering the service to you.

You may download or delete your data at any time through the App. For details on how we handle your data, see our Privacy Policy.

7. Intellectual Property

The App and all associated content, features, functionality, design, code, trademarks, logos, and documentation are the exclusive property of FunctionalMe PBC and are protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the App beyond the limited right to use it in accordance with these Terms.

8. Availability and Modifications

We may modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

We do not guarantee uninterrupted or error-free availability. We are not liable for downtime, service disruptions, or data loss resulting from maintenance, updates, or events beyond our reasonable control.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may terminate your account at any time by deleting your account through the App. Upon termination, your right to use the App ceases immediately. Sections 5, 7, 9, 10, 11, and 12 survive termination.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant the accuracy, completeness, or reliability of any insights or information generated by the App.

11. Limitation of Liability

To the fullest extent permitted by applicable law, FunctionalMe PBC, its founders, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including damages for loss of data, loss of profits, personal injury, or emotional distress, regardless of the theory of liability.

Our total cumulative liability to you for all claims arising out of or related to these Terms or the App shall not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Worcester County, Massachusetts, and you consent to the personal jurisdiction of those courts.
